Commentary by Attorney Michael Grossman
People often think work accidents are open-and-shut because OSHA will just handle everything. First of all, Texas has the most complex work fatality laws of any other firm in the state. There isn't always a guaranteed path toward a fair resolution for a worker's family. As such, they often have to navigate a legal maze in order to get that resolution, which isn't something OSHA handles.
On top of that, though, an accident involving an 18-wheeler on the job site can present additional potential challenges. For example, was this a driver from a separate company who just happened to be on the job site?
Work accident law can still apply in those scenarios, a driver from one company running over a worker from a separate company may fall under ordinary commercial vehicle accident laws—just like an accident where a car and an 18-wheeler crash on the highway. Adding that to the already complex nature of a fatal work accident is sure to be anything but simple.
So, while the facts surrounding this accident aren't clear right now, experience tells me there will likely be unique and significant legal challenges for those involved. It's important steps are taken early to anticipate and prepare for those potential challenges. That way, the worker's loved ones can be as well-equipped as possible to get a resolution that has their best interests at heart.
