Commentary by Attorney Michael Grossman
Just to be clear, I cannot confirm anything alleged in the OSHA summary on this accident or any alleged rule violations by the victim's employer. However, seeing an employer accused of not immediately reporting an accident raises familiar red flags to me. I've actually had work fatality cases where the gap in time between an accident happening and an employer reporting it was actually used to try to cover up and destroy vital evidence. I can't say if that happened here, but that's exactly why it's always important to investigate deadly work accidents as soon as possible. There could be more serious issues to address than just an employer's alleged lack of initiative.
