Commentary by Attorney Michael Grossman
When I read about a crash like this, my first thought is that I hope the injured passenger receives the care he needs and that those affected by this crash get the answers they deserve. While it may seem like a simple case of a vehicle losing control, my experience has shown that crashes like this often have more to them than meets the eye. Before drawing any conclusions, it’s essential to ask three key questions to ensure that every possible factor is considered.
The first question is whether authorities conducted a thorough investigation. Law enforcement officers typically document the scene, take witness statements, and assess visible evidence, but the depth of these investigations can vary. In single-vehicle crashes, it’s common to assume driver error was the cause, but road hazards—such as uneven pavement, debris, or poor visibility—could also contribute. Investigators should take a close look at the crash site to determine if external factors played a role. Additionally, if another vehicle was involved in any way, even if it didn’t make contact, that could be a crucial piece of the puzzle.
The second question—one that is often overlooked—is whether a vehicle defect contributed to the crash. Mechanical failures, such as brake malfunctions, steering issues, or electronic stability control failures, could all cause a driver to lose control. In addition, modern vehicles rely on advanced driver-assistance systems, and if any of these systems malfunction, it could lead to unintended acceleration or loss of control. However, identifying a defect requires a forensic examination of the vehicle, and if it is not preserved, key evidence could be lost before it can be properly analyzed.
The third question is whether all available electronic data has been collected. Most modern vehicles are equipped with an electronic control module (ECM), which records important data such as speed, braking, and steering input in the moments leading up to a crash. Additionally, nearby traffic cameras, dashcams, or even the driver and passenger’s phone data could provide further insight into what happened. This type of evidence is time-sensitive, and if it isn’t secured quickly, it may be lost or overwritten.
At the end of the day, answering these three questions isn’t just about understanding how this crash happened—it’s about ensuring that those affected have access to the full truth. Serious crashes leave families searching for clarity, and the least we can do as a community is make sure that every possible explanation is explored before reaching any conclusions.
