Commentary by Attorney Michael Grossman
When safety violations are alleged, it can seem like everything from there will be straightforward. In Texas, it rarely is. OSHA findings may point to serious concerns, but they don’t necessarily get families the full story they deserve. After all, OSHA's job isn't to look out for the needs of a worker's family. Mostly, they just look for violations, issue appropriate citations, and move on.
That’s why families often need a path independent of the authorities so their questions don’t go unanswered. There is not always a guaranteed process for benefits for a worker's family after an accident under Texas work fatality law. As such, a family having as much information about an accident as possible can be a crucial first step to ensuring they get a just resolution. OSHA might be a part of that, but it's just one piece of a much larger puzzle.
