Commentary by Attorney Michael Grossman
After a serious crash involving a large commercial vehicle, it's important to know how the investigations have been handled. Sometimes, a chaotic crash scene can be beyond the capabilities of a particular department. That's why it often helps to ask key questions early on to hear how authorities respond.
Did authorities have the time, training, and resources to fully investigate the crash?
Collisions involving large vehicles are complex by nature. Tracing impact points, analyzing vehicle trajectories, and piecing together driver actions aren’t tasks that can rely on assumptions. If the responding agency lacks reconstruction expertise or specialized equipment, critical evidence may go uncollected.
Was there a mechanical inspection of both vehicles?
When a smaller car collides with a heavy vehicle like a bus, the cause is often presumed to be human error—but that doesn’t rule out mechanical failure. Problems with brakes, steering, or vehicle systems could have played a role. Without a thorough examination of both vehicles, important contributing factors may remain undiscovered.
Has any electronic data been secured from the vehicles involved?
Modern buses and cars often log data that tracks speed, braking, and steering in the moments leading up to a crash. Additionally, intersections or nearby roadways may be covered by traffic or surveillance cameras. If such data hasn’t been preserved, investigators may have missed an important window to reconstruct exactly what happened.
If authorities can provide satisfactory answers, they can show their investigations have been thorough. But if their answers come up short, then that could mean that getting fair representation of the facts may require more thorough independent investigations.
Takeaways:
- Crashes involving commercial vehicles require investigative detail and expertise.
- Mechanical issues can subtly contribute to accidents and need proper inspection.
- Vehicle and camera data often contain the clearest record of pre-crash behavior.
