Commentary by Attorney Michael Grossman
One of my main concerns with a crash like this is how much time and effort authorities put into the investigations. It isn't that I see any specific signs of poor investigations right now. Rather, I've seen a lot of motorcycle wrecks mishandled simply because people have a negative bias against motorcyclists. This can lead to authorities making mistakes, and it's important to catch that as early as possible.
Let me give an example. I handled a case a while back where an officer wrongfully blamed a motorcyclist for a crash. The officer said the victim was speeding and weaving through traffic before hitting a semi-truck. That officer turned out to be a rookie officer who jumped to conclusions too quickly without properly examining the evidence. After our secondary independent investigations, the evidence clearly showed the motorcyclist was not the cause of the crash. The family's quick thinking to seek out a second opinion helped set the record straight before the mistakes authorities made did too much damage.
So, when a crash like this happens, it can be prudent to verify early what investigators are looking into. If it seems they're considering the details from all angles and letting the evidence speak for itself, families can generally trust that they're going to get the full story. But if details aren't adding up, and authorities are letting bias get in the way of the facts, there may need to be an independent investigation to make sure the victim's side of the story is told fairly.
