Commentary by Attorney Michael Grossman
When a crash happens in the early hours of the morning and results in serious injuries, it's especially important to look beyond surface details. Without clear explanations, the investigation needs to do the work of filling in the gaps—particularly when the injured aren’t in a position to explain what happened.
1. Did the authorities have the time, equipment, and training to fully investigate the crash?
Crashes on high-speed roadways like US 287 require more than a quick visual review. Did investigators reconstruct the sequence of events, examine how the vehicles came into contact, and account for things like speed and lane position? That kind of detail isn’t guaranteed, especially during overnight responses, and it often depends on whether officers had the right tools and experience to dig deeper.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
If one vehicle made a sudden move or failed to respond as expected, a mechanical failure could be involved—issues like a faulty steering component, worn tires, or electronic system errors. These kinds of problems often don’t leave obvious evidence and can easily go unexamined without a targeted inspection.
3. Has all the electronic data relating to the crash been collected?
Both vehicles likely stored information that could help make sense of what happened—speed, braking effort, steering input, and more. GPS data, phone use, and external camera footage could also help clarify the timeline. But if no one moved quickly to retrieve that evidence, the opportunity to get clear answers may already have passed.
Either authorities have taken the time to consider all key pieces of evidence, or there are gaps that need to be filled in. Asking questions early on can help determine how thorough investigations have been so far.
Takeaways:
- It’s unclear whether investigators had the tools or training to fully analyze what led to the crash.
- A mechanical issue inside either vehicle could have contributed and should be ruled out through inspection.
- Vehicle and device data could confirm key actions—if they were secured in time.
