Commentary by Attorney Michael Grossman
It's not surprising to see people in the public speculating that this may have been alcohol-related. I've handled many wrong-way driver cases, and they virtually always involve highly intoxicated drivers. That makes it important not just to investigate the possibility of intoxication but also the possibility a local alcohol provider unlawfully over-served that driver to the point they got on the wrong side of a major freeway. Evidence might show there's a complicit establishment here who needs to be held accountable.
That said, all possible factors are worth attention. It's not exactly common for there to be drunk drivers at 5:00 p.m. on Tuesday. Was there some kind of emergency? Did the driver have a medical condition? Was this an issue related to poor signage or faulty road design? Even if something seems unlikely, a person lost their life. That at least warrants a thorough investigation to get as much evidence as possible rather than just jumping to the most obvious conclusion.
