Commentary by Attorney Michael Grossman
Cellphones are pretty much the first thing I look into following any accident investigation, so it's not unusual to see authorities bring it up here. The question is if they were aggressive enough in obtaining and preserving the cellphone records. Sometimes, authorities think it's enough just to accuse a driver of being on their phone. At the end of the day, though, it's about securing clear evidence, and people don't generally just hand that over willingly.
For example, we handled a case not long ago where a driver's defense team tried to claim his phone was broken at the time of the crash. It took hours of depositions before the driver finally tripped over his own made up story and admitted his phone worked just fine. That's when we were able to get court orders for the phone records, ultimately revealing the driver had been watching adult videos at the time of the crash.
Sometimes, those are the hoops one has to jump through even for something as common as cell phone usage during a serious accident. If that did indeed contribute to this accident, it's important the victim's loved ones know that evidence will be preserved as soon as possible so nothing is overwritten or lost. Not only could that be crucial for seeing accountability here, it could be a big step forward simply for getting the truth.
