Commentary by Attorney Michael Grossman
With any serious crash, it's sometimes easy for people to get a false sense of security. They assume authorities will get all of the answers they need, but many families end up with more questions than answers. It can be crucial, then, to follow up with authorities and ask some key questions.
Did investigators take the time and use the right tools to fully analyze the crash? Intersection collisions require careful examination of traffic signals, sightlines, and vehicle positioning. If authorities focused only on assigning fault rather than fully reconstructing the crash, they may have overlooked contributing factors like road conditions or visibility issues.
Did they consider whether a vehicle defect played a role? Mechanical failures—such as brake malfunctions, steering issues, or faulty acceleration—could have affected one or both drivers. Additionally, if airbags or seatbelts didn’t function properly, injuries may have been more severe than they should have been. Did investigators thoroughly inspect both vehicles to rule out these possibilities?
Did they secure all available electronic evidence? The vehicles’ Engine Control Modules (ECMs) may have held critical data on speed, braking, and steering inputs before impact. GPS records, cellphone activity, and any nearby traffic or security camera footage could also have provided valuable insight. Did authorities take steps to preserve this evidence before it was lost?
Ensuring these questions were answered could make all the difference in understanding what truly happened. If key details remained unclear, further investigation may have been necessary to get the full story.
