Commentary by Attorney Michael Grossman
If alcohol truly was the cause of this accident, I have to wonder if authorities extended their investigations beyond the alleged drunk driver alone. Not many people understand that accidents like this tend to involved negligent alcohol providers, and they can be held accountable, as well.
In Texas, it's unlawful for bars, restaurants, and other alcohol providers to serve people who are obviously intoxicated. Doing so can expose those establishments to potential consequences, including fines from the TABC or liability for injuries resulting from an accident caused by the intoxication.
Too often, this goes completely overlooked. I can't begin to count how many of the hundreds of alcohol-related accident cases I've handled where we were the only ones taking steps to hold a complicit bar or liquor store accountable. Perhaps authorities here have been more thorough, but I have yet to see evidence of that.
