Commentary
When a crash involves an alleged intoxicated driver, the focus is usually on the individual behind the wheel. But an important question that often goes unasked is where that driver got their alcohol and whether they were over-served before the crash.
Texas dram shop laws make it illegal for bars, restaurants, or other alcohol providers to serve alcohol to someone who is obviously intoxicated. If an alleged intoxicated driver had been drinking at an establishment that ignored obvious signs of impairment, that business may share responsibility for what happened here. These laws exist not just to hold businesses accountable but to encourage responsible alcohol service and prevent deadly crashes like this one.
The reason this is important is accountability. I've handled hundreds of intoxication-related accident cases, and the families never wanted an easy explanation or some bad guy to point their finger at. They wanted to know they were getting the full story, and they wanted to see those responsible for the accident face appropriate consequences. Have authorities taken steps here to see that happen?
