Commentary by Attorney Michael Grossman
One thing to consider following any fatal work accident is that Texas has the most complex work fatality law of any other state in the country. There is not always a guaranteed path for a victim's loved ones to get the benefits they need, and this can catch families off-guard. They may even end up at odds with the victim's employer, and getting a fair resolution may require legal strategies and tools the average person doesn't readily have at their disposal. This is why a preliminary OSHA statement is far from the end of the story following a work accident. They may be able to issue appropriate citations and fines, but getting a family the help they need means navigating a legal maze. Generally speaking, the sooner steps are taken to find professionals who can navigate that maze, the better.
