Commentary by Attorney Michael Grossman
Believe it or not, pedestrian accidents can be a lot more complex than people realize. Generally speaking, people tend to just assume it's all about who had the right-of-way. That's important, obviously, but it's just one factor.
Accident reconstructionists also need to know the speed the vehicle was going, visibility at the time of the collision, whether or not the location is poorly designed or missing signage, if something like a medical condition or alcohol contributed to the accident, etc. Frankly, authorities don't always see pedestrian accidents as a high priority, so those details can easily slip through the cracks unless there are independent investigators picking up the slack. Hopefully steps are taken here to ensure those involved are getting the answers they deserve.
