Commentary by Attorney Michael Grossman
When it comes to single-vehicle accidents, things are rarely as simple as people may think. The fact of the matter is they rarely get the attention they deserve, and that can lead to important details slipping through the cracks. In my experience, one helpful action victims and families can take is asking key questions about efforts authorities are making. It can help reveal shortcomings that need further attention.
One critical question is whether the authorities conducted a proper investigation. Single-vehicle crashes can be influenced by numerous factors—road conditions, visibility issues, or even evasive maneuvers to avoid something unexpected. Did investigators examine the scene thoroughly for hazards, document skid marks, or check whether the vehicle struck debris? Were experienced officers assigned to the case, and did they have the right tools to do a comprehensive analysis? If the investigation lacked the time or resources it needed, essential details might remain undiscovered.
Another important question is whether anyone considered the possibility of a vehicle defect. Mechanical issues, like sudden brake failures or steering malfunctions, can make it impossible for even the most careful driver to maintain control. Additionally, safety system failures, such as seatbelts that don’t restrain properly or airbags that don’t deploy, can turn a minor collision into a deadly one. Identifying these issues requires a forensic inspection of the vehicle, which must be done quickly to ensure no evidence is lost.
Lastly, has all relevant electronic data been collected and analyzed? Vehicles store a wealth of information in their Engine Control Modules (ECMs), such as speed, braking, and steering inputs leading up to the crash. Beyond that, other data sources—like cellphone activity, GPS logs, or video from traffic and surveillance cameras—can provide valuable insights into the events surrounding the accident. Authorities don't always move quickly enough to preserve that kind of evidence before it's been overwritten or lost.
Sometimes, authorities are able to provide sensible, satisfactory answers to these questions. Other times, their answers don't add up, and it's clear their investigations weren't thorough. That's when it may be necessary to have independent investigations take the reins. Otherwise, there's no telling what important details may slip through the cracks.
