Commentary by Attorney Michael Grossman
When it comes to single vehicle accidents, I get calls from people often who have concerns that authorities weren't really taking the crash seriously or who didn't bother getting the victim's side of the story before rushing to judgements. This is unfortunately common, but there are a few key questions people can ask to help ensure they get the full story.
Did investigators take the time and have the right resources to properly examine the crash? A vehicle leaving the road and striking a pole could be influenced by road hazards, poor lighting, or even an evasive maneuver. Did authorities document tire marks, roadway conditions, and environmental factors that might explain what happened? If investigators moved too quickly, important details could have been missed.
Did they check for possible mechanical failures? Issues with brakes, steering, or tires can cause a driver to lose control, and failures in safety equipment—like seatbelts or airbags—can make injuries worse. Was the vehicle thoroughly inspected before any potential evidence was lost?
Did they preserve all electronic evidence? The vehicle’s Engine Control Module (ECM) may contain data on speed, braking, and steering inputs before the crash. Other sources, such as GPS records, cellphone activity, or nearby surveillance footage, could provide additional insight. Were investigators careful to secure this information before it was lost or overwritten?
Asking these questions can help people gauge if they're satisfied with the answers authorities come back with. If they are, then authorities likely did good work in their investigations. However, if authorities can't provide clear, sensible answers, there may need to be more thorough independent investigations to clear up any inconsistencies.
