Commentary by Attorney Michael Grossman
When a motorcycle strikes the back of another vehicle, the assumption often leans toward rider error—but the reality is rarely that simple. Crashes like this demand a closer look, especially when serious injuries are involved and key details remain unknown.
1. Did the authorities thoroughly investigate the crash?
Rear-end collisions involving motorcycles require precise reconstruction. Investigators should review whether the truck slowed suddenly, if the motorcyclist had adequate stopping distance, and whether the road surface or traffic flow played a role. The dynamics between a motorcycle and a heavier vehicle also raise questions about visibility and reaction time. If that level of detail wasn’t documented, the cause may still be unclear.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
With motorcycles, even a minor mechanical issue—like brake failure, throttle sticking, or suspension instability—can be catastrophic. It’s essential to inspect the bike for any malfunction that could have prevented the rider from slowing down safely. If those systems haven’t been checked, there’s no way to fully understand whether this was a preventable failure.
3. Has all the electronic data relating to the crash been collected?
While motorcycles don’t always have the same onboard data systems as cars, some do record key performance metrics like speed, brake pressure, and gear position. If the pickup was newer, it might also have captured telemetry data, including braking events or sudden deceleration. This information can help confirm what happened in the final moments before impact. If this data hasn’t been secured, the investigation may be missing critical context.
A rear-end collision involving a motorcycle isn’t always about what the rider did—it’s about what the vehicle did or didn’t allow, and whether the full picture has been uncovered.
Takeaways:
- Rear-end motorcycle crashes must be reconstructed to assess stopping distance and driver behavior.
- Mechanical failures in motorcycle braking or control systems must be investigated.
- Vehicle data, where available, can clarify the sequence of events leading up to the crash.
