Commentary by Attorney Michael Grossman
While the cause of the accident isn't specified right now, the simple fact that it's a fatal work accident likely means the way forward will present significant challenges. Simply put, Texas has the most complex work fatality law in the country. That's due to the fact employers are not required to subscribe to the workers' comp system. That means there may not be any guaranteed path for a worker's family to get the help they need.
Without the right experience and tools to navigate that legal maze, hurdles can quickly become roadblocks. OSHA and local authorities may be looking into what happened here, but the scope of their priorities doesn't necessarily extend to the needs of a worker's loved ones. That usually means there will have to be independent efforts going forward if those involved in a Texas fatal work accident are going to get the results they deserve.
