Commentary by Attorney Michael Grossman
When a vehicle crashes into a building late at night, the damage is obvious—but the cause often isn't. With two people seriously hurt and no other vehicles involved, it's worth asking whether all the right questions are being pursued.
1. Did the authorities thoroughly investigate the crash?
What steps were taken beyond noting the location and vehicle damage? Late-night single-vehicle collisions can be influenced by many factors, but those answers don’t appear on a clipboard. Was the vehicle’s path reconstructed? Were the driver’s actions leading up to the impact evaluated? A complete investigation requires more than checking boxes—it takes time, attention, and experience, especially when people were seriously injured.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
It’s possible the driver lost control, but it’s just as possible the truck didn’t respond the way it should have. Malfunctions like steering linkage failure or brake issues don’t always leave behind obvious clues. Without a qualified mechanical inspection, there’s no way to know whether the vehicle’s condition contributed to what happened.
3. Has all the electronic data relating to the crash been collected?
A modern pickup like this one likely holds key information in its onboard systems. Data about speed, brake use, and steering input in the seconds before the crash could help determine whether the driver tried to avoid the impact or whether the vehicle failed to respond. That kind of clarity can only come if the truck’s data systems are reviewed while the evidence is still fresh.
A crash that sends a truck into a building shouldn’t be explained away with surface-level guesses. When serious injuries are involved, it matters that someone keeps pushing until the facts are clear—not assumed.
Takeaways:
- Crashes into buildings often involve more than just driver error and require thorough review.
- Mechanical failure must be considered when outcomes are this severe.
- Vehicle data could be the key to understanding how the crash actually happened.
