Commentary by Attorney Michael Grossman
When people hear about accidents like this one, they often assume they result from simple driver error. However, in my experience, accidents involving large trucks often require thorough investigations to understand all contributing factors.
First, it's essential to determine what led to the 18-wheeler overturning. Was the truck driver distracted, fatigued, or facing an unexpected obstacle? Mechanical failures or poor maintenance could also have contributed to the truck losing control. Gathering data from vehicle event recorders, reviewing traffic camera footage, and analyzing witness statements will be crucial in piecing together the events that led to this accident.
Next, we must consider the condition and safety of the truck. Was it properly maintained and equipped with functional safety features such as brakes and tires? Mechanical failures can significantly contribute to accidents, and inspecting the truck’s maintenance records can help determine if such issues played a role in this crash.
Additionally, the trucking company’s role must be scrutinized. Was the driver properly trained and adhering to safety protocols? Trucking companies have a responsibility to ensure their drivers are well-prepared for the demands of the road. If the company neglected proper training or allowed unsafe driving practices, they might share responsibility for the incident.
Investigations must go beyond the immediate crash scene to uncover the full story. This includes examining the truck driver’s logs, evaluating their driving history, and consulting with accident reconstruction experts. A comprehensive approach is necessary to ensure that all responsible parties are held accountable.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Whether through obtaining vital evidence or, if necessary, conducting an independent investigation, it’s crucial to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
