Commentary by Attorney Michael Grossman
One of my big concerns following any commercial accident is quite simply: Did authorities look at the crash from all possible angles? It would surprise folks how often a crash came across my desk, and it turned out authorities jumped to conclusions or moved on before giving the crash enough attention. This is why it's often helpful to ask some key questions early on and gauge what kind of responses authorities come up with.
Did the crash receive the full attention it warranted from investigators?
Any crash involving an 18-wheeler and serious injuries should trigger a thorough and methodical investigation. These collisions are complex by nature, and understanding what happened requires more than a surface-level review. Was the scene documented in detail? Did investigators reconstruct vehicle paths or examine contributing factors like timing and spacing? Without that kind of focused effort, critical evidence may already be missing.
Has anyone considered whether a mechanical issue could have played a role?
When two vehicles collide, especially involving a commercial truck, mechanical failures are always worth considering. A sudden brake issue, steering malfunction, or trailer instability could lead to a crash even with experienced drivers behind the wheel. If neither vehicle was carefully inspected, it’s impossible to say with confidence whether all contributing factors have been ruled out.
Was crash-related data from either vehicle collected?
Both the Kia Sedona and the Peterbilt truck are likely equipped with systems that capture key data—speed, braking input, throttle use, and more. That information can help clarify what occurred in the seconds leading up to the crash. Cell phone records and any possible video evidence should also be secured promptly. If these steps aren't taken in time, vital evidence could end up lost or overwritten.
Generally speaking, if authorities have adequate answers to these questions, it's likely a sign they're doing their due diligence. But if their answers leaves doubts and concerns, that can be a sign for victims and families to have a second set of eyes look things over. Otherwise, something important might slip through the cracks.
Key Takeaways:
- Crashes involving 18-wheelers require detailed and experienced investigation.
- Vehicle issues—if uninspected—can remain hidden factors in serious collisions.
- Electronic data can reveal how events unfolded, but must be collected promptly.
