Commentary by Attorney Michael Grossman
When a vehicle makes a sudden maneuver, overcorrects, and ends up in a deadly crash, it's critical that investigators move beyond basic assumptions and thoroughly examine all potential contributing factors. In this case, three key questions must guide the process: (1) Did the authorities conduct a complete and detailed investigation? (2) Has anyone explored whether a mechanical issue or vehicle defect played a role in the loss of control? (3) Has all the electronic data from the involved vehicles been collected and reviewed?
Overcorrection often stems from a split-second reaction—sometimes in response to a perceived threat that doesn’t leave enough time for recovery. Investigators should closely evaluate the road layout, traffic density at the time of the crash, and any visual obstructions or lane design issues that might have contributed to the failed lane change. It’s also important to determine whether the vehicle that was occupying the intended lane was visible and moving at a predictable speed.
The Honda Civic involved should be subject to a detailed mechanical inspection. A problem with the steering system, brakes, or suspension could have magnified the consequences of an overcorrection. Even tire condition and inflation can significantly affect a vehicle’s ability to remain stable during abrupt maneuvers. If the vehicle had a history of unresolved recalls or maintenance issues, those must be included in the investigative review.
Electronic control module (ECM) data may provide a clear picture of the moments leading up to the crash—vehicle speed, throttle and brake input, steering angle, and more. This data can help determine whether the driver attempted to correct course and whether the vehicle responded as expected. Timely retrieval of this information is essential to preserve its accuracy.
Until these three areas—road conditions, mechanical integrity, and digital data—are fully examined, the full cause of the crash remains uncertain. A comprehensive investigation is not only necessary to understand what led to this fatal outcome, but also to identify any factors that can be addressed to improve roadway safety and prevent similar crashes in the future.
