Commentary by Michael Grossman
As open-and-shut as things may seem, gathering and preserving evidence should still be a priority. I've seen a lot of inexperienced lawyers who thought they had a slam dunk just because a driver was facing a charge or citation. Then once it came time to prove their case, the insurance companies walked all over them because they didn't pull cellphone records, map the scene, inspect the vehicles, pull vehicle data, look for video evidence of the crash, etc. Authorities have their own priorities to worry about. It's up to victims and families to make sure someone is looking out for their needs going forward—no matter how straightforward things may seem.
