Commentary
When people see "work accident," they may be too quick to write things off. They just assume OSHA and workers' comp will take care of everything. However, things aren't always so simple. For example, any accident involving cargo comes with questions about who loaded that cargo and whether or not they did so properly.
For example, I handled a case a while back where a fatal incident occurred due to improperly loaded cargo. Through our independent investigations, it turned out that the company that delivered the cargo and the company that actually loaded it improperly were separate companies. If something like that caused this accident, it's possible that the legal path available to the victim's loved ones would fall outside the bounds of a typical work accident.
That's why, regardless of what ultimately happened here, it should always be a priority to gather as much evidence as possible. It's important that a victim's loved ones are fully informed about what next steps are available to them, but it's also important they know they're getting the full story, as well.
