Commentary by Attorney Michael Grossman
When a motorcycle goes down in a turn, it’s easy to assume the rider simply misjudged the curve. But serious crashes like this rarely happen without a cause, and a careful investigation is the only way to uncover what really happened.
1. Did the authorities thoroughly investigate the crash?
A motorcycle leaving the road in a turn leaves behind important evidence. Tire marks, lean angle, and the bike’s final resting position can all reveal whether the rider attempted to brake, swerved suddenly, or experienced a sudden loss of stability. If investigators don’t reconstruct these details, the explanation risks being left at “loss of control,” which doesn’t answer the deeper question of why control was lost.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Motorcycles are highly sensitive to equipment issues. A brake imbalance, suspension failure, or tire problem could make a routine turn nearly impossible to manage. If the Yamaha wasn’t carefully inspected before being cleared from the scene, a defect that contributed to the crash may never be discovered.
3. Has all the electronic data relating to the crash been collected?
Some newer motorcycles store limited data, while rider phones, GPS units, or even helmet cameras may provide useful details about speed, braking, and steering inputs. If that evidence isn’t preserved, the opportunity to understand how the crash unfolded may be lost.
A single-vehicle motorcycle crash may look simple on paper, but the reality often runs deeper. Getting to the truth depends on whether investigators examine the rider’s actions, the motorcycle’s condition, and the available data together.
Takeaways:
- It’s unclear whether investigators reconstructed the Yamaha’s path through the turn.
- A possible tire, brake, or suspension issue may not have been ruled out.
- Digital evidence from devices or the bike itself could provide important context if reviewed.
