Commentary by Attorney Michael Grossman
When a motorcyclist is seriously injured in a single-vehicle crash involving a median barrier, many assume it was a simple case of rider error. But in my experience, particularly in late-night crashes like this one on U.S. 90 near Probandt Street, there’s often more going on than meets the eye. To truly understand what caused this collision and whether it could have been prevented, there are three key questions that should be asked.
First, did the authorities conduct a thorough investigation? A crash at 2:30 a.m. raises immediate questions about lighting conditions, road visibility, and whether the median barrier was clearly marked and properly illuminated. Investigators should determine whether the rider had a clear view of the road and whether any sudden roadway changes—like lane shifts or narrowing—might have contributed to the crash. If those conditions weren’t fully examined, a more detailed, independent review may be necessary to determine what role the roadway itself may have played.
Second, has anyone explored whether a mechanical failure contributed to the loss of control? Striking a median could suggest the motorcycle drifted or swerved unexpectedly, which may be due to steering or suspension issues, a tire failure, or a malfunction in the braking system. Mechanical failures don’t always leave obvious signs at the scene and require a forensic examination of the motorcycle—something that’s only possible if it’s preserved after the crash.
Lastly, has any electronic or supporting data been collected? While most motorcycles don’t come equipped with traditional event data recorders, some aftermarket GPS systems or mobile apps might capture speed and location data. Surveillance footage from nearby traffic cameras or businesses could also help reconstruct the crash. Even phone records might offer context. As with any electronic evidence, it’s crucial to act quickly to ensure that information is preserved.
When a crash results in serious injuries and the full story isn’t immediately clear, assumptions can leave critical questions unanswered. Asking these questions is the least that can be done to ensure that those affected by this crash get the clarity and closure they deserve.
