Commentary by Attorney Michael Grossman
When a motorcyclist ends up seriously injured in a single-vehicle crash, especially in the early morning hours, it’s easy for the report to stop at “lost control.” But that explanation misses the real issue: whether anyone has taken the time to figure out why control was lost in the first place.
1. Did the authorities thoroughly investigate the crash?
Overnight crashes often happen with no witnesses and limited lighting, which makes a proper investigation even more important. Did officers analyze the motorcycle’s path, road surface conditions, or signs of evasive maneuvers? Were there obstacles, fluid spills, or irregular pavement that might have gone unnoticed? Without close attention to the crash scene, it's far too easy to assume operator error without looking further.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
If the motorcycle unexpectedly veered or flipped, the possibility of a mechanical failure can’t be ruled out. A sudden brake lockup, tire blowout, or suspension issue can all lead to a loss of control—especially at low-visibility hours when there's no room for error. These kinds of problems aren’t always obvious after the fact unless the motorcycle is preserved for inspection.
3. Has all the electronic data relating to the crash been collected?
Modern motorcycles often include digital systems that track lean angle, throttle input, brake pressure, and even stability control activity. That information can help show whether the rider was accelerating, braking, or struggling to maintain balance. If a phone or connected device was in use, it might also clarify whether distraction played a role. But this data needs to be secured quickly—once it's gone, so are the answers it might have held.
Calling it a “loss of control” doesn’t explain what really happened. When someone’s seriously hurt, the facts don’t stop at what’s obvious—they start there.
Takeaways:
- Overnight motorcycle crashes demand close inspection of the road, lighting, and vehicle trajectory.
- Possible brake, tire, or suspension issues should be ruled out with a full mechanical review.
- Digital data from the motorcycle or rider’s devices may offer key insight into how the crash unfolded.
