Commentary by Attorney Michael Grossman
When a serious crash happens in the early hours of the morning, it leaves behind more than just debris on the roadway. Questions hang in the air: about what truly happened, whether anything could have been done to prevent it and whether all the facts will come to light. These aren’t just details; they’re pieces of a bigger picture that matter to everyone involved.
Did the authorities thoroughly investigate the crash? Given the limited information, it’s unclear how in-depth the crash investigation went. When motorcycles are involved, especially in nighttime crashes, it's critical for authorities to do more than a surface-level review. That means mapping the crash scene in detail, tracing the paths of both vehicles and confirming whether either driver’s behavior before impact played a role. Some departments have the tools and training to carry out these steps thoroughly; others may not. Without confirmation that a full reconstruction was performed, there’s always the risk that key facts remain unknown.
Has anyone looked into the possibility that a vehicle defect caused the crash? Motorcycles have less room for error, both in how they’re handled and how they’re built. If something like a brake line failure or throttle issue occurred, it might not be obvious without a mechanical inspection. The same goes for the other vehicle. Its condition should be checked, too. People often assume crashes like this are just about speed or visibility, but without digging into the hardware, we may overlook a problem that could affect others down the line.
Has all the electronic data relating to the crash been collected? There’s a lot more evidence these days than just skid marks. GPS data, speed tracking, even phone usage history can help paint a fuller picture of what happened in those final moments. Some motorcycles and most newer vehicles carry systems that record important information. Traffic cameras in an urban area like Houston might also hold critical footage. The question is whether anyone has pulled and reviewed all of it.
Digging deeper into a crash like this isn’t just about assigning blame. It’s about learning the truth. When something goes wrong in the middle of the night, there’s a duty to ask every hard question, because those answers may be the only way to keep it from happening again.
Key Takeaways:
- It's unclear if the crash scene was fully reconstructed or just given a basic review.
- No mention has been made of checking either vehicle for mechanical issues.
- It's not known whether phone data, onboard systems or camera footage were reviewed.
