Commentary by Attorney Michael Grossman
When I see reports of a crash like this, my main concern is whether the people involved—and their loved ones—will get the answers they need. Multi-vehicle accidents, especially those involving pedestrians, can be incredibly complex, and initial reports often leave many critical questions unanswered. That’s why it’s essential to examine three key issues when looking into what happened.
The first question is whether authorities have conducted a thorough investigation. Law enforcement officers will likely document the scene, speak with witnesses, and attempt to determine the sequence of events. However, with multiple vehicles and a pedestrian involved, reconstructing the crash accurately can be challenging. Were all drivers obeying traffic laws? Did the pedestrian have the right of way? Were there any contributing roadway factors, such as poor lighting or obstructed signage? Given the severity of the crash, it’s important to ensure that no detail is overlooked in determining how this tragedy unfolded.
The second question to consider is whether anyone has looked into the possibility of a vehicle defect. In a crash involving multiple cars, it’s easy to assume driver error was the primary cause, but mechanical failures can play a role. If a vehicle experienced a brake failure, an acceleration issue, or even an unnoticed recall-related defect, that could have contributed to the chain of events. Unfortunately, vehicle defects are often ignored in crash investigations unless someone specifically pushes for that possibility to be explored. A forensic examination of all vehicles involved could help determine whether a mechanical issue played a role.
Finally, it’s important to determine whether all relevant electronic data has been collected. Each vehicle’s engine control module may have stored crucial data about speed, braking, and steering input before the crash. Surveillance footage from nearby businesses or traffic cameras could provide a clearer picture of what occurred. Even cellphone data from those involved could help clarify whether distraction played a role. The sooner this evidence is secured, the more useful it will be in understanding exactly what happened.
At the end of the day, answering these questions could be essential to understanding what really happened and why. A thorough examination of all three of these issues—including the quality of police investigations, possible vehicle defects, and electronic data—is the least that can be done to ensure that those affected by the crash receive the clarity they deserve.
