Commentary by Attorney Michael Grossman
When a serious crash happens in the quiet hours of the night, people are often left wondering how a moment’s lapse or mechanical failure can lead to such a sudden turn. In the absence of clear answers, what matters most is making sure the right questions get asked, because that’s how real understanding begins.
Did the authorities thoroughly investigate the crash? The time of the crash, just after 1 a.m., raises the question of whether investigators had adequate lighting and resources to capture a full picture of what occurred. It’s not enough to note the direction the vehicle was headed and where it stopped. Proper crash analysis should involve mapping the vehicle’s trajectory, measuring skid marks and determining the exact point of impact. It's also unclear if the driver’s actions before the crash — whether he was distracted, fatigued or possibly impaired — were looked into. These are the kinds of factors that need to be examined with more than a surface-level review.
Has anyone looked into the possibility that a vehicle defect caused the crash? When a vehicle crashes into a parked car without any immediate external cause, it's fair to ask whether something went wrong mechanically. A stuck accelerator, brake system failure or even a steering issue could have played a role. Unless someone conducted a post-crash inspection of the Chevrolet Equinox, those possibilities remain unanswered. Just because a defect isn’t obvious doesn’t mean it isn’t there.
Has all the electronic data relating to the crash been collected? The Equinox likely holds valuable digital evidence: everything from its onboard computer data to phone or GPS activity leading up to the crash. These tools can show if the driver hit the brakes, swerved or had been using a phone. Without retrieving and reviewing this data, any conclusion about what happened is based more on assumptions than facts.
Until someone takes a closer look at how and why this crash occurred, there’s a real chance the most important answers will be missed. Getting it right isn’t just about accountability. It’s about preventing the next one.
Key Takeaways:
- A proper crash investigation goes beyond surface-level observations.
- Mechanical failures can't be ruled out without a detailed inspection.
- Onboard vehicle and phone data can clarify what actually happened.
