Commentary by Attorney Michael Grossman
Serious crashes often leave more questions than answers. When the scene clears and the headlines fade, what matters most is whether anyone took the time to look closely at how and why it happened.
One question that should always be asked is whether authorities conducted a thorough investigation. In a single-vehicle crash, it’s easy to assume the cause without digging deeper. But did investigators go beyond a basic scene review? Was the crash scene mapped in detail? Did anyone reconstruct the vehicle’s path or examine steering inputs and braking patterns? Was the driver’s conduct in the minutes leading up to the crash carefully reviewed? Not every officer has the same level of training in crash reconstruction. Some are highly skilled, while others may only document the obvious and move on. The difference can shape how well the truth is understood.
Another important issue is whether anyone considered the possibility of a vehicle defect. When a newer model vehicle is involved, it’s worth asking whether the car was inspected for mechanical failure. A stuck accelerator, brake malfunction, steering issue or sensor error can all play a role in a single-vehicle crash. These problems are not always visible at first glance. Without a careful mechanical inspection, a hidden defect could be missed, and assumptions could take its place.
It’s also critical to know whether all available electronic data was preserved and reviewed. Modern vehicles record information about speed, braking, throttle position and more in the moments before a crash. That data can confirm whether the driver attempted to slow down or steer away. Phones may show whether distraction was a factor. GPS records and nearby cameras can add context. If this information isn’t collected quickly, it can be lost. Once that happens, key pieces of the puzzle may be gone for good.
Crashes like this deserve more than surface-level answers. A full understanding only comes when investigators look past the obvious, test the vehicle itself and secure the electronic record before it disappears. When those steps are taken, the conclusions carry weight. When they aren’t, doubt remains.
Key Takeaways:
- A serious crash calls for detailed reconstruction, not just a basic report.
- Mechanical issues should be ruled out through a careful vehicle inspection.
- Electronic data from the vehicle and devices can provide clear, objective answers.
