Commentary by Attorney Michael Grossman
When a serious crash happens in the early morning hours and involves someone allegedly running a red light, it’s easy to draw a straight line from violation to outcome. But red-light cases aren’t always as open-and-shut as they first appear—especially when two people walk away with significant injuries and the cause remains “unknown.”
Did the authorities thoroughly investigate the crash?
Intersections bring complexity, and so do early-morning crashes. Did investigators confirm the signal pattern using the traffic light's cycle records? Were there any cameras at the intersection that could verify who had the green? Without reviewing signal timing or gathering digital evidence, it’s difficult to be sure what really happened. Basic field reports often leave these questions open.
Has anyone looked into the possibility that a vehicle defect caused the crash?
While most people assume running a red light is a driver’s mistake, it’s not always that simple. A brake failure, delayed system response, or even a faulty sensor in a vehicle's safety system could prevent a driver from stopping in time. This is especially relevant when high speeds are involved or when cars rely on electronic driver aids. Unless the vehicles are inspected with these questions in mind, critical clues might be missed.
Has all the electronic data relating to the crash been collected?
Both vehicles likely contain event data recorders capable of logging brake use, speed, throttle position, and steering input just before the crash. That data can clarify whether the driver of the Lexus tried to stop or had any system warnings. GPS, telematics, and intersection cameras—if available—can also offer insight into who entered the intersection when, and at what pace.
Red-light crashes don’t always come down to bad decisions. Sometimes, they’re about missed signals, mechanical failures, or safety systems that don’t respond when they should. Getting the full picture means asking the questions most people overlook.
- Intersection crashes need signal timing verification and camera review to confirm fault.
- Mechanical issues or delayed system responses can play a role in apparent red-light violations.
- Vehicle data helps confirm whether drivers attempted to brake or if their cars failed to respond.
