Commentary
With pedestrian accidents, people tend to only focus on who had the right-of-way. Important as that is, it's not the only factor to consider. Generally speaking, investigations need to determine if the collision was reasonably avoidable. Did the driver have an opportunity to stop or go around the victim, or would an attentive, responsible driver have been unable to avoid the collision? Answering that requires careful investigation of the circumstances surrounding and leading up to the collision. Those are details a standard police report may not cover.
