Commentary by Attorney Michael Grossman
When it comes to pedestrian accidents, people too often jump to conclusions based solely on who they believe had the right-of-way. That's obviously an important detail, but the law concerns itself with the full context of an accident. A driver hitting someone outside of a crosswalk isn't magically absolved of any potential wrongdoing in the same way a pedestrian isn't automatically in the right just because they're not in a car. At the end of the day, it's important to find out what conditions surrounded the accident, how avoidable it was, and whether or not there were unusual circumstances to consider.
