Commentary by Attorney Michael Grossman
Looking up this area, there's a convention center, hotels, and restaurants all in a compact area. No doubt it's a busy place for people to go out at 10:00 p.m. on Saturday night, whether it's just an informal outing or a specific event. I can't help but wonder if one of these venues had anything to do with the alleged intoxication that led to this accident. If so, let me explain why that's so important.
In Texas, establishments that serve alcohol can also find themselves in trouble if they contribute to a serious accident. Texas law says it's illegal for an alcohol provider to serve someone who's obviously intoxicated. If they do so, and that intoxication leads to someone getting hurt, the establishment can be on the hook for criminal charges, civil liability, and administrative penalties like fines or suspended licenses.
Whether it's a bar, a restaurant, a catering company, an event center, or even a gas station, improper service of alcohol puts lives at risk. As such, just as there are consequences for intoxicated driving, there are consequences for licensed alcohol providers breaking the law. Maybe that all doesn't apply to this specific incident. But this area is no doubt an important center of entertainment for residents of McAllen and the surrounding areas. They shouldn't have to worry that one of the local establishments benefiting from their patronage is also putting their lives at risk.
