Commentary
With pedestrian accidents, things aren't always as simple as whether or not someone was in a crosswalk. For example, if a pedestrian is clearly visible and far away enough to avoid, drivers have to avoid them, right-of-way or not. And if someone isn't clearly visible or avoidable, it would be ridiculous for a driver to be responsible for something they couldn't avoid. How that played out here remains to be seen, of course. That would depend on whether or not authorities took steps behind the scenes to reconstruct the scene and get some clear answers about what happened here.
