Commentary by Attorney Michael Grossman
When two vehicles collide, it can be challenging to determine what went wrong—especially when injuries are involved. People often assume that authorities will piece together the truth quickly and accurately, but not every crash gets the time or resources it deserves. That’s why it’s important to ask the right questions early.
First, did investigators properly document the scene? Intersections require attention to detail, including vehicle positions, road markings, debris pattern, and witness statements. If any of that was missed, the reliability of the investigation could already be in question.
Second, was there a check for any vehicle defects that may have contributed? Problems with brakes, steering systems, or even malfunctioning airbags or seatbelts can affect both how a crash happens and how severe the injuries turn out to be. These issues are often overlooked unless someone insists on a proper inspection.
Lastly, was crash-related electronic data collected from the vehicles? Many cars store information like speed, braking, and steering input right before a crash. That data, along with potential surveillance footage or phone records, can offer important context—but only if it’s preserved quickly.
Making sure these questions are asked helps ensure those affected have a clear, complete understanding of what actually happened. Either authorities can alleviate their doubts with clear answers, or they can show that there are gaps in the story that independent investigations may be able to fill in.
