Commentary by Attorney Michael Grossman
At this time of night, it would frankly be unusual if authorities didn't consider alcohol as a possible factor. But even if this was a drunk driving crash, that leaves another important detail to look into: Where did that alcohol come from?
Not a lot of people realize that alcohol providers in Texas can be held responsible for contributing to serious accidents. If they unlawfully over-serve someone, and that person harms themselves or others as a result, the alcohol provider can face consequences under Texas law.
So while some might think this is all pretty straight-forward, the reality is these reports may just be the tip of the iceberg. Depending on what details come to light, there could still be a local establishment putting the community at risk who needs to be called out.
