Commentary by Attorney Michael Grossman
While details didn't confirm that alcohol was a factor here, it would certainly explain why a driver was on the wrong side of the road. What makes that particularly concerning, though, is that every case I've handled involving a wrong way driver was someone who had been unlawfully over-served by an alcohol provider. That's why it's important to find out where a drunk driver got their alcohol from. Negligent alcohol providers can also be held accountable if they contribute to accidents like this. If evidence shows they over-served someone, and that leads to people getting hurt or killed, an alcohol provider may be exposed to criminal investigations, fines, or liability for the resulting injuries.
Frankly, that isn't something authorities always look into on their own. If authorities do find that alcohol was a factor here, they may simply charge that driver and consider things closed there. As such, more thorough independent investigators may be necessary here to make sure those involved in the crash know they're getting the whole story. That's especially true if there's an accomplice to all of this who needs to face appropriate consequences.
