Commentary by Attorney Michael Grossman
I've seen a lot of talk in the news about concerns over safety at this intersection. That's always an important conversation to have, especially since it seems the victim was directly involved in efforts to improve safety at this location. However, there's another very crucial subject I have yet to see anyone talk about: Why wasn't the driver able to avoid this accident?
While it is a myth that pedestrians always have the right-of-way, this incident appeared to involve a woman who was familiar with the area, and it happened at an intersection controlled by traffic lights and seemingly with clearly-marked crosswalks. On top of that, reports suggest the victim was very familiar with this area. I have a very hard time believing that the victim would have suddenly made a mistake leading to the accident. Of course, it's important that the evidence speaks for itself.
Have authorities looked at the driver's phone records? Did they pull vehicle data to see how fast the truck was going and how long before the collision the brakes were activated (if at all)? Did they check for nearby cameras to see who had the right-of-way? Were there any independent witnesses who saw what happened?
Like I said, discussing potential improvements at a dangerous intersection is important. At the end of the day, though, it's likely just one factor of many that could have contributed to the fatal accident. There's only so much safety improvements can do before one has to consider people's behavior. I just hope authorities aren't being too narrow in their efforts and letting important evidence slip through the cracks.
