Commentary by Attorney Michael Grossman
In light of the fatal accident that occurred during the morning hours of March 27th on FM 907 near Beaumont Street, involving a Dodge Ram that veered off the roadway and struck a light pole, it is critical to focus on the three foundational questions that guide any meaningful investigation: (1) Did the authorities thoroughly investigate the crash? (2) Has anyone looked into the possibility that a vehicle defect caused the crash? (3) Has all the electronic data relating to the crash been collected?
At this time, official statements have confirmed that the vehicle left the roadway for reasons not yet identified. In single-vehicle crashes like this, it’s common for assumptions to center around driver error or distraction. But those assumptions can obscure other contributing factors unless the investigation includes a meticulous review of all available evidence. Were road conditions a factor? Was there an obstruction or sudden mechanical failure? A proper investigation requires scene analysis, physical evidence collection, and, when possible, witness interviews. The extent of that work isn’t clear from the initial reports, and until it is, we can’t know whether all reasonable avenues are being explored.
Equally important is considering whether a defect or malfunction in the Dodge Ram may have contributed to the crash. A sudden loss of control might point to problems with steering, brakes, suspension components, or even the electronic systems that manage those functions. These kinds of mechanical failures don’t always leave obvious signs at the scene, and unless someone takes the initiative to conduct a detailed inspection, particularly with an eye toward known safety issues or recalls, the potential for a defect may go entirely unexamined. That’s a critical gap in many crash investigations.
Lastly, a key question that often goes overlooked is whether the vehicle’s electronic control modules (ECMs) have been accessed and their data preserved. These modules can store vital pre-crash information such as vehicle speed, throttle input, braking activity, and steering behavior. This data can help investigators understand what the vehicle was doing in the moments leading up to the crash. But this information can be lost if not downloaded in a timely manner—particularly if the vehicle has been removed from the scene or damaged beyond repair.
Until these three questions are fully and thoroughly answered, the true cause of this crash may remain uncertain. A complete investigation that includes a review of mechanical integrity and electronic data not only ensures that nothing is overlooked but also supports broader efforts to improve roadway and vehicle safety for everyone.
