Commentary by Attorney Michael Grossman
When a head-on crash leaves someone seriously injured, it’s not enough to simply note that one vehicle crossed the line. The real questions start where the first report ends—especially when the cause isn’t clearly known.
1. Did the authorities thoroughly investigate the crash?
Authorities aren't always given the tools, time, or experience they need to properly investigate a serious car accident. When that happens, important details start to slip through the cracks. That's why it can be a problem if it seems officers are understaffed, under-budget, or overworked.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
When a vehicle veers out of its lane unexpectedly, mechanical failure should always be considered. That includes steering issues, brake failure, or even sensor malfunctions that misguide the driver. Beyond that, were safety systems like airbags or seatbelts functioning properly on both sides? A defect in either vehicle could have played a role in both the crash and the injuries that followed.
3. Has all the electronic data, cell phone records, and nearby camera footage been collected?
Vehicle data from both cars could provide hard facts—speed, brake usage, and steering behavior just before the crash. Checking cell phone records might confirm or rule out distraction. And even on rural roadways, nearby businesses, homes, or traffic infrastructure may offer camera footage that captured the collision or events leading up to it. All of these should be reviewed to get the full story.
Surface details only go so far. When one driver ends up seriously hurt, getting to the truth requires a full investigation—not just a summary of blame.
Takeaways:
- Thorough crash reconstruction is critical when a vehicle crosses into oncoming lanes.
- Vehicle defects or safety system failures may have contributed to the crash or injuries.
- Data from the cars, phones, and local cameras can offer essential context.
