Commentary by Attorney Michael Grossman
While people generally jump to conclusions with pedestrian accidents, they can be just as complex as any serious accident. What was visibility like? What are road markings and signage like in the area? Have authorities preserved electronic data, such as dash cam video and cell phone records? Are there witnesses who are available for follow-up interviews? Is this an area with frequent pedestrian incidents? These are the kinds of questions I would have following a serious pedestrian accident, yet they're questions I often see overlooked. Maybe authorities have been more thorough here, but that remains to be seen.
