Commentary by Attorney Michael Grossman
When it comes to fatal accidents, people often have concerns that the investigations aren't going to tell the victim's side of the story. That's entirely reasonable, and that's why investigations need to be as thorough as possible. That's why it can be helpful to ask key questions early on and gauge how investigations are being handled.
First, did authorities have the proper tools and time to document the scene? Important details like vehicle positions, road conditions, and skid marks are easy to miss if the investigation is rushed or under-resourced. Without them, it’s hard to build an accurate picture of what took place.
Second, has anyone checked for a possible vehicle defect? Mechanical issues—like brake or steering failure—or problems with airbags or seatbelts can either cause a crash or make the outcome worse. These problems aren’t always obvious and can be missed if no one calls for a proper inspection.
Finally, was electronic crash data collected from the vehicles? Most modern cars record key data leading up to a crash, including speed, braking, and steering input. If secured quickly, this information can provide vital insight and help fill in the gaps when the facts aren’t clear.
If authorities don't have clear answers to these questions, then it could be a sign they aren't taking the investigations seriously. That's when there may need to be steps from independent investigators to help ensure nothing important slips through the cracks.
