Commentary by Attorney Michael Grossman
If the allegations here prove to be true, following up on those recommended charges would definitely be a sign authorities are taking this awful event seriously and seeing there are consequences for the alleged drunk driver. What I have yet to see, though, is if they also looked into where that driver got their alcohol. Authorities can usually retrace a drunk driver's steps, find the bar they were drinking at, and ensure that bar faces consequences if they contributed to the crash by over-serving the drunk driver. Unfortunately, I've seen too many situations where authorities never even bothered looking for a bar.
The reality is that most alcohol providers avoid consequences because police have other responsibilities they feel are a higher priority, and the Texas Alcoholic Beverage Commission is stretched so thin across the state that they can hardly follow up on all of the pending cases they already have. There have been numerous times over the years our firm pursued a wrongful death case against a bar, gathered a mountain of evidence of their wrongdoing, handed it to authorities on a silver platter, and authorities still didn't bother following up.
That's why, especially out in these rural areas, it's crucial that folks know their rights and understand the steps that can be taken to ensure there are proper consequences after a crash like this. With that knowledge, they can demand steps be taken to hold all responsible parties accountable.
