Commentary by Attorney Michael Grossman
Single-vehicle crashes often lead people to assume driver error was the primary cause, but that assumption can overlook other important factors. Determining what really happened requires a careful look at several key questions.
First, did the authorities conduct a thorough investigation? Officers may have noted general details, but did they examine factors such as road conditions, visibility, or any hazards that could have contributed to the wreck? If the truck overturned, was there evidence of a prior loss of control, such as tire marks or debris patterns? Without a detailed investigation, critical information could be missed.
Second, has anyone looked into whether a mechanical issue or vehicle defect played a role? A pickup truck rolling over suggests the possibility of stability issues, steering malfunctions, or even tire failures. If something on the vehicle failed unexpectedly, the driver may have had little ability to correct the situation. A full inspection of the truck could help determine if any defects contributed to the wreck.
Finally, have all available electronic data sources been reviewed? The truck’s event data recorder (EDR) could provide key insights, including speed, braking, and steering inputs leading up to the crash. This data can help clarify whether the driver attempted to regain control or if the truck reacted in an unexpected way.
At the end of the day, answering these questions could be essential to understanding what really happened and why. A thorough examination of all three of these issues—including the quality of police investigations, possible vehicle defects, and electronic data—is the least that can be done to ensure that those affected by the crash receive the clarity they deserve.
