Commentary by Attorney Michael Grossman
When a single-vehicle crash occurs, many assume it must have been due to driver error. While that’s possible, it’s important to consider all potential contributing factors to get a full and accurate picture of what happened. That requires answering three key questions.
First, did the authorities conduct a thorough investigation? Officers may have documented the crash, but did they go beyond the obvious? Were there any hazards on the roadway that could have contributed to the vehicle leaving the road? Did they account for possible distractions, mechanical issues, or other external influences? If the investigation was superficial, critical details may have been overlooked.
Second, has anyone considered the possibility of a mechanical failure? If the vehicle suddenly veered off the road without clear driver input, that could indicate an issue with the steering, brakes, or even a tire failure. A proper mechanical inspection could reveal whether a defect or maintenance issue contributed to the crash.
Finally, have all electronic data sources been reviewed? The vehicle’s event data recorder (EDR) could provide crucial insights into what happened in the moments leading up to the crash—whether the driver attempted to brake, how fast they were traveling, and if any steering corrections were made. Without reviewing this data, conclusions about what happened may be based on assumption rather than fact.
At the end of the day, answering these questions could be essential to understanding what really happened and why. A thorough examination of all three of these issues—including the quality of police investigations, possible vehicle defects, and electronic data—is the least that can be done to ensure that those affected by the crash receive the clarity they deserve.
