Commentary by Attorney Michael Grossman
When a single-vehicle crash leaves someone seriously injured, as in this Denton County accident, it's essential that investigators take a comprehensive approach to uncover all contributing factors. From my experience, this process should be guided by three critical questions: Was the crash thoroughly investigated? Could a vehicle defect or maintenance issue have played a role? And has all relevant electronic data been secured?
Was the crash thoroughly investigated? Officials indicate that the Ford Mustang left its lane of travel, but it’s unclear why that happened. Was the driver distracted, fatigued, or affected by a medical emergency? Did external factors like poor lighting, road design, or debris contribute to the crash? Without answers to these questions, it's impossible to understand the circumstances fully. Investigators should also examine whether weather or road conditions played a role in making the roadway less forgiving of minor errors.
Could a vehicle defect or maintenance issue have played a role? The fact that this was a single-vehicle crash should prompt investigators to closely examine the Mustang for any mechanical or maintenance-related issues. Did something fail in the vehicle’s steering or braking systems? Were the tires worn or underinflated? A hidden defect or overlooked maintenance issue could have compromised the vehicle’s ability to remain safely in its lane. A thorough mechanical inspection should be conducted to rule out these possibilities.
Has all relevant electronic data been secured? Vehicles like the Ford Mustang often contain event data recorders (EDRs) that capture critical information, such as speed, steering inputs, and braking activity, in the moments before a crash. Accessing this data could clarify whether the vehicle was speeding, if the driver attempted to regain control, or if mechanical issues contributed. Additionally, if nearby surveillance cameras or dashcam footage exists, it could provide valuable context for how and why the crash occurred.
Accidents like this one demand careful and thorough investigation to uncover every contributing factor. By addressing these critical questions, investigators can help provide clarity about what happened and why. For the injured man and his loved ones, obtaining these answers is an important step toward clarity and closure.
