Commentary by Attorney Michael Grossman
When accidents like this happen, it’s easy for people to assume they result from a brief error or a challenging roadway curve. However, based on my experience, crashes involving large trucks require a closer look to uncover the full range of contributing factors.
In cases where a truck fails to navigate a curve and collides with a barrier, it’s important to investigate possible issues beyond driver handling. Mechanical factors, such as brake or steering malfunctions, are critical to examine because even a small failure in these systems can make controlling a large vehicle in a curve difficult or impossible. With an 18-wheeler carrying heavy cargo like sand, any problem with equipment can also amplify the truck's instability, especially around curves. Additionally, investigators should consider whether factors such as driver distraction or fatigue could have impaired the driver’s ability to make necessary adjustments for the road ahead.
If the truck was operated by a commercial company, it’s essential to look into the company’s adherence to safety regulations, particularly maintenance routines and driver preparation. Ensuring that large trucks are fit for the road and that drivers are trained to handle challenges like sharp curves is a crucial part of safe operations. Any lapse in these areas could suggest shared responsibility for the accident.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires an independent investigation to obtain critical evidence, it’s essential to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
