Commentary by Attorney Michael Grossman
Given these initial reports, it seems authorities got the ball rolling on making sure the alleged drunk driver here faces significant consequences. However, that might not be the end of the story. Anytime alcohol contributes to a crash, as authorities allege here, it's important to know where the alcohol came from. There could be an accomplice to all this chaos: a negligent alcohol provider.
Simply put, Texas law says alcohol providers can be responsible if they unlawfully over-serve someone and that intoxication leads to people getting hurt. Whether that's a bar, a restaurant, a liquor store, or even a gas station, they have rules to follow. Breaking those rules should have consequences.
The reason I bring this up is because this area of the law rarely gets the attention it deserves. A crash like this tends to create a lot of chaos for the authorities to handle. As such, their efforts usually focus solely on what's immediately apparent at the crash site itself. They may go to great lengths to see an alleged drunk driver held accountable for their actions. But if a law-breaking alcohol provider contributed to the crash, they might slip under the radar. That means it's business as usual for them, and they'll continue putting the community in danger.
Accountability after a serious accident means accountability for all parties whose actions led to people being harmed. If that was just one reckless driver who decided to drink and drive and run from police, that's one thing. But if multiple parties broke the law and contributed to the accident, they should all answer for those actions.
